ANJANA MISHRA ORAL ORDER 29-11-2017 Heard learned Senior Counsel for the petitioners and learned Additional Public Prosecutor for the State. A supplementary affidavit has been filed today in which it has been submitted at paragraph No. 3 that accused Anil Rai has surrendered on 23.11.2017 in connection with Ganga Bridge P.S. Case No. 83 of 2015 before the learned Additional Chief Judicial Magistrate-I, (In-charge), Hajipur, Vaishali. The petitioners are apprehending their arrest in connection with the Ganga Bridge P.S. Case No. 83 of 2015 registered for the offences punishable under Sections 304(B), 201 of the Indian Penal Code and Section 3⁄4 of the D.P. Act. Learned Senior Counsel for the petitioners submits

Patna High Court Cr.Misc. No.31424 of 2017 (4) dt.29-11-2017 2/2 that the present two petitioners being the mother-in-law and brother-in-law of the deceased have had no role to play in the case and now that the husband of the deceased lady has surrendered, it would be appropriate and in the interest of justice that these two petitioners be extended the privilege of anticipatory bail. Having considered the entire facts of the case and on consideration of the supplementary affidavit filed today, let the petitioners abovenamed, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Ganga Bridge P.S. Case No. 83/2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
