====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 17-02-2018 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Khaira (Nagara) P.S. Case No.244 of 2017 registered under Sections 341, 323, 324, 307, 34 of the Indian Penal Code. Learned counsel for the petitioner submits that there is a vague allegation of assault against this petitioner. However, perusal of the F.I.R. would show that the specific allegation of assault by Talwar is attributed to the accused Sonu Kumar. All injuries have been found to be simple in nature. Learned A.P.P. for the State is present.

Considering the facts and circumstances, as the petitioner is not said to have caused assault on any vital part of the

Patna High Court Cr.Misc. No.6939 of 2018 (2) dt.17-02-2018 2/2 body and the only allegation is against Sonu Kumar, I am inclined to grant anticipatory bail to this petitioner. In case of his arrest/surrender before the court below within four weeks, let the above named petitioner, namely, Dipak Kumar @ Dipak Kumar Rai, be enlarged on bail on furnishing bail bonds of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Xth, Saran at Chapra, in connection with Khaira (Nagara) P.S. Case No.244 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
