This application for anticipatory bail arises out of Alamnagar P.S. Case No. 22 of 2020 for the offence punishable under Sections 302, 201 and 120B of the Indian Penal Code. The informant is the brother of the deceased. It is alleged that the deceased had gone to drop a close relative of coaccused Pinku Mandal to her matrimonial home. He thereafter did not return and his dead body was subsequently found lying at a place near the house of Nemo Mandal.

Learned counsel appearing on behalf of the petitioners has submitted that suspicion is the only basis for

Patna High Court CR. MISC. No.22274 of 2020(5) dt.06-01-2021 2/2 implication of the petitioners and other accused persons. No motive has been assigned in the First Information Report implicating the petitioners.

On perusal of the case diary, I do not find any specific detail available justifying petitioners' implication. Considering the above, this application is allowed. Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Kishunganj, Madhepura, in Alamnagar P.S. Case No. 22 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
