10-02-2015 Heard learned counsel for the parties.

It is pointed out by learned counsel for the appellant in former appeal that this appeal has already become infructuous since filed against initial order of the court below directing to maintain status quo that has now been vacated by final order passed therein on the issue on 15.06.2011 giving rise to later appeal by plaintiff appellant Surya Narayan Mishra.

It is also pointed out that the solitary appellant in later appeal is no more and his heirs have already been substituted in former appeal. Enabling learned counsel for the said appellant (deceased) to do further needfuls, if so
