JUSTICE SUDHIR SINGH ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 25(1-A), 25(1-AA), 25(1-Ac), 25(1-b) A and 26 (i) (ii) (iii) of the Arms Act.
Allegation, according to informant, who is a police officer, is that on information he along with police force raided the place Paru Mandal Tola and arrested petitioner along with two other persons. On search, a pistol was recovered from the possession of petitioner. From the place of occurrence mini gun manufacturing equipments were also recovered. It has been submitted on behalf of the petitioner that he is in custody since 5.9.2015. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. Recovery of arms from the possession of petitioner is denied. There is no compliance of Section 100 of the Code of Criminal Procedure. Other co-accused have been granted bail vide Cr. Misc. no. 30192 of 2016 and Cr. Misc. no. 22016 of 2016.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned A.D.J.-V, Munger , in connection with Bariyarpur P.S. Case no. 140 of 2015 (G. R. No. 1668 of 2015) giving rise to S. T. no. 321 of 2015. (Sudhir Singh, J) sudip/- U T
