The prayer for bail of the petitioner was earlier rejected by this Hon'ble Court vide order dated 1.11.2018 passed in Cr. Misc. no. 60245 of 2018.

In the written report it is alleged that this petitioner fired at the son of the informant while he was going to board train, which hit on his head and he died due to aforesaid injury. Learned counsel for informant has submitted that petitioner is the main assailant. Delay in conclusion of trial is not on account of the prosecution.

Report has been received from the Court below from

Patna High Court CR. MISC. No.24786 of 2019(4) dt.19-06-2019 2/2 which it appears that case is pending for hearing on discharge petition filed by petitioner.

Learned counsel for petitioner submits that now charge has been framed in this case and examination of witnesses has started.

In such circumstances, since petitioner is the main assailant, this Court is not inclined to enlarge the petitioner on bail.

Prayer of the petitioner for grant of bail is rejected at this stage.

Trial Court is directed to conclude the trial within a period of nine months from the date of receipt/production of copy of this order by fixing the case either on day to day basis or by giving short adjournments and send compliance report to this Court.
