JUSTICE RAVI RANJAN ORAL ORDER 11-08-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends her arrest in a case registered for the offence punishable under Sections 420, 467, 468 of the Indian Penal Code.
It is contended on behalf of the petitioner that the certificate concerned was granted by her after 32 persons of the Panchayat had supported the application filed by Sangeeta Kumari by putting their signature/thumb impression, a copy of which has been appended as Annexure-2. After grant of the certificate, the concerned lady Sangeeta Kumari had filed an affidavit also, a copy of which has been appended as Annexure-3. Moreover, it is stated that she has not been able to get benefit of the said certificate as no appointment of any post has been given to her on
Patna High Court Cr.Misc. No.31259 of 2016 (2) dt.11-08-2016 2/2 the basis of the certificate issued by the petitioner. She claims to be the Mukhiya of the Panchayat and is a lady and has stated that her antecedent is clean.
Having regard to the facts and circumstances of the case and also the fact that the petitioner is a lady, let her be released on bail in the event of her arrest/surrender before the court below within a period of six weeks from today in connection with Khudwan P.S. Case No.19/2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
