This is an application for grant of anticipatory bail in connection with Sitamarhi Mahila P.S. Case No. 21 of 2017 registered for the offences punishable under Sections 363,365,376,34,120(B) of Indian Penal Code and Sections 4,5,6 of Prevention of Immoral Traffic Act.
Learned counsel for the petitioner has submitted that there is no allegation of overt act against this petitioner. In the written report, it is alleged that the victim girl(informant) was kidnapped by four persons in a tempo and they have brought her to Muzaffarpur Railway Station and they kept her confined in a room. Thereafter, she has been brought to a house in Sitamarhi, where she learnt that she has been purchased for Rs. 2,00,000/- by one Gope Khalifa. Gope Khalifa and his wife wanted the
Patna High Court Cr.Misc. No.7314 of 2018(2) dt.20-02-2018 2/2 victim girl to do illegal work for money. The informant refused to do so then she was assaulted by them. It is further alleged that two other persons also used to force her to do illegal act. She heard their name as Manjoor Khalifa and Ramjan Khalifa and when she protested, they also assaulted her. The victim girl in her statement under Section 164 Cr.P.C. leveled specific allegations against Gope Khalifa. She has leveled general and omnibus allegation against this petitioner.
It has been further submitted that this petitioner has clean antecedent which is apparent from para 3 to the bail application. In such circumstances, the abovenamed petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be released on anticipatory bail furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi Mahila P.S. Case No. 21 of 2017 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
