JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered under Sections 420, 467, 468, 469, 471 and 120B of the Indian Penal Code and Section 138 of the Negotiable Instrument Act.

Allegation is that the petitioner is Assistant Manager, UCO Bank, Chapra and huge amount of Chapra Municipality has been transferred in the account of another person and the said transfer of amount has been made on the basis of forged and fabricated cheque bearing different signature of the informant and the offence has been committed due to negligence of the Bank officials.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the

Patna High Court Cr.Misc. No.28158 of 2017 (2) dt.06-07-2017 2/2 petitioner. The petitioner has falsely been implicated in the present case. The petitioner is an Assistant Manager in the UCO Bank, Chapra Branch. He has no concern with the UCO Bank, Ekma Branch. The alleged occurrence is said to have taken place in respect to UCO Bank, Ekma Branch. The other accused has been granted anticipatory bail vide Annexure-3 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Town P.S. case No.552 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
