JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-12-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 323, 324, 325, 307, 504 of the Indian Penal Code.

The prosecution case is that all the accused persons assaulted the handicapped brother of the informant causing grievous injury. It is alleged that petitioner No. 1 assaulted the informant.

It is submitted by learned counsel for the petitioners that accusation is omnibus and general. Though the impugned order reflects that one injury has been received by the brother of the informant but the opinion with regard to the nature of injury has been kept reserved. The petitioners' side

Patna High Court Cr.Misc. No.56071 of 2015 (2) dt.10-12-2015 2/2 lodged Raghopur P.S. Case No. 25 of 2015 at earlier point of time against the informant and others.

A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hajipur at Vaishali in connection with Raghopur P.S. Case No. 33 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
