The petitioner seeks bail in anticipation of his arrest in connection with Vaishali (Belsar OP) P.S. Case No. 207 of 2019 dated 07.06.2019 instituted for the offences under Sections 30(A)/32(2)/41(1) of the Bihar Prohibition & Excise Amendment Act, 2018.

In view of the petitioner having been made an accused in a case of similar nature earlier, I am not inclined to exercise my discretion for grant of anticipatory bail to him.

Accordingly, the prayer for anticipatory bail is rejected.

However, if the petitioner surrenders before the

Patna High Court CR. MISC. No.34957 of 2021(2) dt.21-01-2022 2/2 court below and seeks bail, his application shall be considered on its own merits without being prejudiced by the fact that the present petition on his behalf has not been entertained.
