The petitioner seeks bail in Begusarai Nagar P.S. Case No. 36/2019, instituted for offence under Section(s) 414 of the Indian Penal Code.

It is alleged in the written report that during vehicle checking the petitioner was caught with motorcycle. He could not produce any paper with regard to the motorcycle. It is further alleged that number plate of motorcycle was blank and Engine number was erased.

Learned counsel for the petitioner has submitted that petitioner has been made accused merely on suspicion. There is no recovery of any incriminating article from possession of this petitioner. In fact motorcycle was standing near station and

Patna High Court CR. MISC. No.23382 of 2019(2) dt.11-04-2019 2/2 police was searching the seizure-list witness to seize the motorcycle. The petitioner refused to become seizure-list witness then he has been implicated in this case. Petitioner is in custody since 15.01.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, in connection with Begusarai Nagar P.S. Case No. 36/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
