Petitioner apprehends his arrest in Dumariyaghat P.S. Case No.21 of 2019, registered under Sections 272, 273 and 34 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act.
The informant got secret inputs of keeping huge quantity of illicit liquor in the house of Vinod Rai, son of Ramvidya Rai, the petitioner and they were selling it illegally. On such information, a raid was conducted but Ramvidya Rai, the petitioner and his both sons Vinod Rai and Bihari Rai managed to flee away. On search more than 200 litres of Indian made foreign liquor of different brands was recovered from the house of the petitioner.
Patna High Court CR. MISC. No.23560 of 2019(2) dt.12-04-2019 2/2 Learned counsel for the petitioner submits that for the recovery of the liquor, two sons and father, the petitioner, have been made accused. The father has no say in the family. He is an old man but the recovery of such huge quantity of liquor from the house of the petitioner itself shows that the father and his two sons appears to have involved in illegal sale of Indian made foreign liquor.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Jha, J) S.KUMAR/- U T
