This application has been filed for quashing the F.I.R. bearing Jehanabad P.S. Case No. 865 of 2022 dated 12.09.2022 under Section 370(A) of the IPC, Section 3/4/5/6 of the Immoral Traffic Prevention Act and Section 8 of the POCSO Act. The prosecution story in short is that one Nikhil Kumar, SHO Town P.S. Jehanabad in his written report to Special Judge, POSCO, Jehanabad alleged that on secret information that illegal flesh trade is being run by the management of Omkara rest house and Shiva Satya rest house which was situated near Civil Court, Jehanabad in Alok apartment. Police raided the said premises and arrested several boys and girls from the room of both rest house who were found there in compromising condition. It is further alleged that all
Patna High Court CR. MISC. No.25728 of 2023(2) dt.21-04-2023 2/2 persons including owner/management of Omkara rest house/Shiv Satya rest house were involved in the alleged offence.
In view of the law laid down by the Hon'ble Supreme Court in the case of Neeharika Infrastructure Pvt Ltd. V. State of Maharshtra and others (2020) 10 SCC 118, this application is dismissed.
