JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 28-02-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Pakribarawan P.S. Case No. 172 of 2017 registered under Sections 304B and 201 read with 34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that co-accused Amirak Yadav and Lalo Devi having exactly identical allegation have already been granted pre-arrest bail by a Bench of this Court vide order dated 17.02.2018 passed in Cr. Misc. No.2630 of 2018.

Patna High Court Cr.Misc. No.12572 of 2018 (2) dt.28-02-2018 Mr. Bharat Lal, learned Additional Public Prosecutor for the State also admitted that the case of the petitioner stands on identical footing to that of co-accused Amirak Yadav and Lalo Devi, who have already been granted pre-arrest bail by this Court.

Considering the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Nawada in connection with Pakribarawan P.S. Case No. 172 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
