The petitioner apprehends his arrest in Maranchi P.S. Case No. 13 of 2014 registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code. The informant made allegation that the petitioner and Niraj Kumar kidnapped his minor daughter and took to Delhi. The informant followed them to Delhi.
Learned counsel for the petitioner submits that the victim made her statement under Section 164 Cr.P.C. and she disclosed that only Niraj Kumar and one unknown forcibly took her to Delhi on a train. The victim did not disclose the name of the petitioner.
Considering the fact aforesaid and the fact that the
Patna High Court Cr.Misc. No.18563 of 2017 (6) dt.06-07-2017 2/2 victim, herself, did not disclose the name of the petitioner as her kidnapper, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna in Maranchi P.S. Case No. 13 of 2014, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
