The petitioner is in custody in connection with Bettiah Town P.S. Case No. 1027 of 2018 for the offences under Sections 398, 401 of the Indian Penal Code and Section 25(1-b) (a), 26, 35 of the Arms Act, 1959.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 02.12.2018. He further submits that in the instant case one country made pistol with live cartridge were recovered from the possession of the petitioner.

Considering the fact that petitioner has no criminal antecedent and he has remained in custody for more than four
