The petitioner apprehends his arrest in connection with Babubarhi P.S. Case No. 165 of 2016 for the office registered under Sections 409, 419 and 420 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is the Secretary of Vidyalaya Shiksha Samiti of Primary School Parbatiya Tole under Babubarhi Block and the allegation is that the petitioner along with the Principal of the school had received a sum of Rs. 4 lakhs for the construction of the school building but the same was not constructed and the present Programme Officer without verifying the facts has filed the present case. It is further submitted that on enquiry, it has come that the school building

Patna High Court Cr.Misc. No.16519 of 2018 (2) dt.06-04-2018 has been constructed but only the windows and other furnishing works have not been conducted. It is further submitted that the Principal of the school against whom there is similar allegations, has been extended the privilege of regular bail vide order dated 01.02.2018 passed in Cr. Misc. No. 4414 of 2018.

In view of the aforesaid facts and circumstances of the case and that it has been found that part of the building was already constructed, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-II, Madhubani in connection with Babubarhi P.S. Case No. 165 of 2016, subject to the condition as laid under Section 438(2) Cr.P.C.
