The petitioner apprehends his arrest in Pratapganj P.S. Case No. 27 of 2016, registered for the offences punishable under Sections 420 and 409 of the Indian Penal Code. A case was lodged against the petitioner for not submitting the folder, merit list, application forms, educational qualification of the Panchayat teachers appointed in the year 2006 in Tekuna Panchayat situated in the district Supaul. Learned counsel for the petitioner submits that the petitioner was posted in Tekuna Panchayat on 16.01.2013 and his predecessor did not hand over any papers with regard to appointment of Panchayat Teachers to him after taking of charge,
Patna High Court Cr.Misc. No.30179 of 2016 (2) dt.09-09-2016 2/2 therefore the petitioner is not responsible for missing of any records of appointment of teachers in Tekuna Panchayat. Considering the facts aforesaid and the fact that the petitioner was not posted at Tekuna at the time of appointment of Panchayat teachers, he had taken charge as Panchayat Secretary of Tekuna Panchayat in the year 2013, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Birpur at Supaul in connection with Pratapganj P.S. Case No. 27 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
