The petitioner apprehends his arrest in a case registered under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. On a tip off about congregation of the accused persons for committing robbery at Rauniya More, informant along with police force arrived there and spotted four persons standing with the motorcycle. Out of them three managed to escape and one namely Sonu Kumar @ Kancha was apprehended and one loaded country made pistol and one live cartridge was recovered from his possession. Aforesaid apprehended accused disclosed the name of the petitioner as one of his fleeing accomplices in the occurrence.
Patna High Court CR. MISC. No.31110 of 2019(2) dt.13-05-2019 2/2 It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. There is nothing in the record indicating the complicity of the petitioner in the occurrence barring the confessional statement of the apprehended accused namely Sonu Kumar due to animosity. No incriminating article has been recovered from the conscious physical possession of the petitioner. Petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Danapur, Patna in connection with Naubatpur P.S. Case No. 52 of 2019, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
