The petitioners apprehend their arrest in Barahara (Sinha O.P.) P.S. Case No. 294/2017, instituted for the offences under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code.
There happens to be allegation against petitioner no. 2 Manoj Kumar Singh, who had inflicted Dao blow over the head of the informant Mithilesh Kumar Singh, while petitioner no. 1 Matuk Singh @ Matuk Dhari Singh had assaulted with rod. Though, from the order impugned, it is evident that nature of the injury has not be incorporated but as per Annexure-2
Patna High Court Cr.Misc. No.8993 of 2018 (2) dt.17-02-2018 2/2 the victim has sustained 4" x 1/6" x1/6" lacerated wound caused by hard and blunt substance.
That being so, it is a good case wherein the learned lower court will consider the prayer for bail in case, the petitioners surrender before the learned lower court and pray for bail as, the injury report completely falsifies the case.
With the aforesaid observation, the instant petition is disposed of.
