The petitioners seek pre-arrest bail in connection with Neemchandpura P.S. Case No. 35 of 2015 registered under Sections 341, 323, 448, 307, 386, 406 and 420/34 of the Indian Penal Code.
It would be evident from the allegations made in the FIR that on the point of pistol the petitioners demanded rangdari and took away Rs. 5,000/- from the pocket of the informant.
Patna High Court Cr.Misc. No.44654 of 2015 (2) dt.14-10-2015 2 / 2 Learned counsel for the petitioners has contended that the instant case has falsely been instituted and subsequently, at the intervention of friends and well-wishers the matter has been settled outside the court.
Since the offences alleged are not compoundable in nature and the allegations are quite serious, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, the application filed under Section 438 Cr. P.C. is rejected. (Ashwani Kumar Singh, J.) Sanjeet/- U T
