ANJANA MISHRA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Motihari Mahila P.S. Case No.04 of 2015, G.R. Case No.427 of 2015 for allegedly having committed the offence under Sections 313, 376, 372, 373/343, 370A(2) of the Indian Penal Code and Sections 3, 4, 5 and 6 of the Immoral Traffic Prevention Act.

Learned counsel for the petitioner submits that admittedly, the petitioner and the informant had been married and were living together as husband and wife for three years, whereafter the informant joined the orchestra party. The allegation now has been filed only because there was some

No.32698 of 2016 (2) dt.23-12-2016 2/2 difference between the two regarding the payments which were received at the orchestra by the informant and for the said reason, a false and malicious allegation has been made against the present petitioner. He further submits that the statement made under Section 164 Cr.P.C. is opposite to the statement made in the F.I.R. and subsequently, the parties have also compromised.

Considering the discrepancy in the statement made by the informant in the F.I.R. and the statement under Section 164 Cr.P.C., let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Motihari Mahila P.S. Case No.04 of 2015, G.R. Case No.427 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
