The petitioner apprehends his arrest in connection with Motihari Town P.S. Case No. 575 of 2018 registered for the offence punishable under Sections 413, 414/34 of the Indian Penal Code.
Murari Kumar, Tamatar @ Vishal Sahani and Shahrukh @ Ajaharuddin Siddiqui were apprehended along with a stolen motorcycle. On quizzing, they divulged the name of the petitioner as member of their gang and according of aforesaid motorcycle to them by the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence.
Patna High Court CR. MISC. No.25598 of 2019(2) dt.26-04-2019 2/2 He has also no concern with the seized motorcycle. He happens to be cane juice seller and simple gullible person. There is nothing cogent on record indicating the complicity of the petitioner in the occurrence barring the disclosure made by the aforesaid apprehended accused persons due to animosity. Petitioner has no criminal antecedent.
In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari in connection with Motihari Town P.S. Case No. 575 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
