JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-08-2020 Heard Mr. Anuj Kumar Srivastava, learned Advocate for the petitioner and Mr. Ram Priya Sharan Singh, learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Marhowrah P.S. Case No. 851 of 2019 dated 13.12.2019 instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

The petitioner is not named in the FIR. He is sought to be implicated in this case on the basis of the fact that the recovery of two bottles of liquor has been made from the vehicle owned by him. Learned counsel for the petitioner has submitted that the vehicle was being driven by his driver and he had carried the liquor for his own consumption without the knowledge of the petitioner.

The petitioner is stated to be a person of clean antecedents. Considering the aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of this order on his furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Saran in connection with Marhowrah P.S. Case No. 851 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
