The petitioners seek bail in connection with Warisnagar P.S. Case No. 48 of 2024 instituted for the offence under Section 414 of the Indian Penal Code.

The allegation against the petitioners along with others is of engaging in committing theft and there has been recovery of 40 mobile phones and cash of Rs. 2,50,000/- from a Car.

It has been submitted on behalf of the petitioners

Patna High Court CR. MISC. No.29106 of 2024(2) dt.20-04-2024 2/3 that the petitioners are in custody since 17-02-2024. Petitioner are stated to be man of clean antecedent.

It has been further submitted by the petitioners' counsel that petitioners have been falsely implicated in the present case. No incriminating/looted article has been recovered from the conscious possession of the petitioner. So far as recovery of car is concerned, the same belongs to the father of petitioner No. 1. On the basis of suspicion and in order to save the real culprits, the police has falsely implicated the petitioners in the present case. Other co-accused has been granted bail by this Court vide order dated 09-04-2024, passed in Cr. Misc. No. 26892 of 2024.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioners, clean antecedent of the petitioners and claim based on parity, this Court is inclined to grant bail to the petitioners. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Warisnagar
