The petitioner has renewed his prayer for grant of regular bail in a case registered under section 395 of the Indian Penal Code.

As per the prosecution case, it is stated by the informant that six unknown accused persons on the point of pistol committed dacoity and took away ornaments and cash as stated in the F.I.R.

It is submitted by learned counsel for the petitioner that the F.I.R was registered against six unknown. In course of investigation one accused Saddam Nat was caught in whose confessional statement the name of several accused persons including one Ankit Kumar transpired. Further in the confessional statement of the said co-accused Ankit Kumar, the

Patna High Court CR. MISC. No.25282 of 2022(3) dt.12-01-2023 2/2 name of the petitioner transpired. No incriminating article has been recovered from the petitioner's possession. He is in custody since 22.2.2022 and has been falsely implicated in the case because of his antecedents.

The application for bail is opposed by learned A.P.P for the State who submits that the petitioner has fourteen criminal antecedents.

Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation, no incriminating article having been recovered from the petitioner's possession who is in custody since 22.2.2022 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Uchkagaon P.S. Case no. 358 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj.
