JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 13-01-2015 The petitioner has filed the instant application against the order dated 11.04.2011, passed by the Principal Judge, Family Court, Buxar in Maintenance Case No. 43 (M) of 2009. Before this Court, the petitioner had expressed his willingness for restoring the dignity and status of opposite party no.2.

In view of the submissions of the petitioner that he is willing to keep his wife with full dignity and status, the matter was referred to Mediation Centre, Buxar.

A report has been called for from the Secretary, District Legal Services Authority, Buxar and from the report it appears that opposite party no.2 is not interested in conciliation. Counsel for opposite party no.2 also states that her

The petitioner submits that he has paid all the arrears amount in view of order dated 10.04.2014 and order dated 26.11.2014.

This Court vide order dated 10.04.2014 observed that the petitioner would continue making payment of the maintenance amount to the opposite party no.2 at the rate of 1,500/- per month. Counsel for the petitioner submits that he does have sufficient land and he earns by way of daily wage basis. In the circumstances, the maintenance amount of Rs.2,000/- is reduced to Rs. 1,500/-, which the petitioner will continue to pay till any order is passed in any other suit/proceeding under Hindu Marriage Act.

This application stands disposed of.
