The appellant is apprehending his arrest in Mohiuddin Nagar P.S. Case No.18 of 2017 for the offence under Sections 447, 342, 323, 379, 354, 307 of I.P.C. and Section 3(1) (x) of the SC & ST (Prevention of atrocities)Act.

Allegation as per the F.I.R. against the appellant is of abusing the informant calling by her caste.

Submission of the learned counsel for the appellant is that the land belongs to the appellant and he purchased it by a registered sale deed in spite of that the informant is claiming the land and, as such, dispute arose and the present false case has been filed due to extract money.

Patna High Court CR. APP (SJ) No.1732 of 2017 (2) dt.22-08-2017 2/2 Heard learned Special A.P.P. also and opposed the prayer on the ground of maintainability.

Having heard both sides and in view of the facts and circumstances, as state above, let the appellant, above named, surrender before the learned court below and pray for regular bail who shall consider the same on its own merit on the basis of the aforesaid submissions and pass an appropriate order on the same day without being prejudiced by this order.
