The petitioners seek quashing of the order dated 13.04.2010 passed by the Judicial Magistrate 1st Class, Begusarai in Complaint Case No. 180C of 2009.

The case of the complainant is that the accused persons used to always beat her and on the date of occurrence assaulted her and also committed theft of her personal property. It has been submitted on behalf of the petitioners that in the background of the case, property dispute is made out. The core complaint and rest of the allegations are imaginary. In fact the S.D.M, Teghra on 23.12.2008 had recommended for initiation of 107 Cr.P.C proceeding so as to restrain the parties.
