2. Heard learned counsel for the petitioner and learned A.P.P. for the State.
3. The petitioner seeks regular bail in connection with S.Tr. No. 1376 of 2022 arising out of Ghoswari P.S. Case No. 100 of 2022 dated 07.07.2022 lodged under Sections 341, 323, 324, 326, 307 and 504/34 of the I.P.C.
4. As per the prosecution, the F.I.R. has been lodged against three named accused persons including the petitioner. The specific allegation against the petitioner that he has provided knife to his father who attacked by knife on the informant due to which he injured and admitted to hospital.
5. Learned Counsel for the petitioner submits that there
Patna High Court CR. MISC. No.27565 of 2023(2) dt.06-06-2023 2/2 is no allegation of any attempt or assault upon the present petitioner. He further submits that antecedent of the petitioner is clean and he is in custody since 07.07.2022. Counsel further submits that the dispute was going on between the informant and petitioner's father but with a view to teach lesson, the petitioner and his father both were made accused in this case. He further submits that there is no allegation of assault against the petitioner.
6. Learned counsel for the State opposes the prayer for bail.
7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-Ist, Barh, Patna in connection with S.Tr. No. 1376 of 2022 arising out of Ghoswari P.S. Case No. 100 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C..
