2. The petitioner apprehends his arrest in connection with Triveniganj P.S. Case No.55 of 2023 instituted under Sections 419, 420 and 34 of the Indian Penal Code and Section 10 of the Bihar Conduct of Examination Act, 1981.

3. As per the prosecution case, co-accused Subodh Kumar was appearing in examination on behalf of co-accused Anuj Kumar, who is the son of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is quite innocent and has falsely been implicated in this case on the basis of suspicion. The petitioner is not named in the F.I.R. There is no material against the petitioner and only due to the fact that he is the father of co-accused Anuj Kumar,

The petitioner has two criminal antecedents; out of which, in one case he has been acquitted and in another case he is on bail. The petitioner is a government teacher and there is no chance of his absconding. He undertakes to co-operate in the investigation.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. I, Supaul, in connection with Triveniganj P.S. Case No.55 of 2023, subject to the conditions as laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
