The petitioner apprehends his arrest in Special Case No. 66 of 2013, arising out of Vigilance (Patna) P.S. Case No. 61 of 2013 registered for the offences punishable under Sections 406, 420 and 120(B) of the Indian Penal Code and under Sections 13(2), 13(1)(d) of the Prevention of Corruption Act, 1988.

The petitioner was supplier of different apparatus and machines in PMCH.

It is submitted that the petitioner filled up the tender. After proper verification of technical and financial bid the quotation of the petitioner was found suitable at lowest price thereafter the petitioner supplied the machines and different apparatus to PMCH. It is further submitted that other accused persons have already been granted

Patna High Court Cr.Misc. No.48181 of 2015 (4) dt.21-07-2016 2/2 anticipatory bail vide order passed in Cr. Misc. No. 1177 of 2014 and others by a common order on 21.09.2015. The case of the petitioner stands on the same footing.

Learned counsel for the vigilance department did not dispute this fact that similarly situated accused persons have already been granted anticipatory bail.

Since the case of the petitioner stands on the same footing, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Vigilance-1, Patna in Special Case No. 66 of 2013, arising out of Vigilance (Patna) P.S. Case No. 61 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further that the petitioner shall appear on each and every date and shall not be absent on two consecutive dates without reasonable ground during the course of trial and also accept the police papers.
