This application for grant of anticipatory bail arises out of Amour P.S. Case No. 54 of 2016, disclosing offences under Sections 147,323,324,307,379/504 of the Indian Penal Code.

From the First Information Report, it appears that the occurrence had taken place during the course of voting in the last Bihar Panchayat Elections. at Middle School, Basatpur in the District of Purnea. There are all together 31 persons, including the petitioners, named in the First Information Report. The petitioner No.1 allegedy assaulted Januddin on his head by sword, whereas, petitioner No.2 gave blow with garasha on the head of one Azad Ansari. Learned Senior counsel appearing on behalf of the

petitioners has submitted that though the doctors have recorded the injuries caused on Januddin and Azad Ansari grievous in nature but the same has been found to have been caused by hard and blunt substance. He has also submitted that prior to lodging of the present Amour P.S. case No. 54 of 2016, an FIR being Amour P.S. Case No. 49 of 2016 was registered by Jikrul Ansari, who is accused No.1 in the First Information Report.

Considering the above, this application is allowed. Let petitioners above-named in the event of their arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in Amour P. S. Case No. 54 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
