====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-09-2016 Heard learned counsels for the petitioner and the State. The petitioner being mother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

The prosecution case is of killing the sister of the informant after about 16 years of marriage by causing burn injury and disposing of the dead body. As per own admission of the informant, the marriage was performed in 1999 and the victim died on 9.4.2016. The informant has further admitted that he was being informed that his sister has been killed and the dead body has been disposed of.

Patna High Court Cr.Misc. No.35925 of 2016 (2) dt.07-09-2016 2/2 It is submitted by the learned counsel for the petitioner that admittedly the informant is not eye witness to the occurrence. The impugned order also does not suggest that there is any eye witness to the occurrence and the petitioner claims to be separate from the husband of the victim.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM- 8, Bhojpur at Ara in connection with Agiaon Bazar P.S. Case No.21 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
