JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-07-2017 After some argument learned counsel for the petitioner seeks permission to withdraw the petition in order to enable the petitioner to file a petition for regular bail on surrender. If such a petition is filed by the petitioner on surrender within a period of one month from today, the court below is expected to dispose of the application without being prejudiced by the withdrawal of this application. It goes without saying that the court below will consider the case of the petitioner on its own merit including the statement of the girl under Section 164 Cr.P.C.

With the aforesaid observations, the application stands disposed of.
