JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 08-05-2023 Heard learned counsel for the petitioner and the State. The petitioner has a grievance that he has been illegally charged a fine of Rs.45,500/- by the respondent department.
It appears that the petitioner has directly moved this Court for redressal of his grievance.
If he has any grievance against the illegal demand and collection of fine by the respondent authorities, he is at liberty to file an appropriate application before the District Magistrate, Jamui (respondent no. 2) within a period of 30 days from today. If any such application is filed by the petitioner, the same will be examined and after giving an opportunity of hearing to the
Patna High Court CWJC No.6274 of 2023(2) dt.08-05-2023 2/2 petitioner, the same will be decided by the respondent no. 2 within a period of 90 days from the date of submission of the representation.
In case, it is found that the truck of the petitioner was illegally detained and/or fine has been collected from him unlawfully, the respondent no. 2 shall take the consequential action in accordance with law.
