ANJANA MISHRA ORAL ORDER 05-08-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 08.09.2018 in connection with S.T. No.04/2019 arising out of Shahkund (Sajour) P.S. Case No.196 of 2018 registered for the offence under Sections 302, 307, 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the main allegation is against the husband of the sister of the informant and not the present petitioner. No overt act has been attributed to the present petitioner and he has just been named in connection with the present case.

Considering the aforementioned facts and circumstances and also because similarly situated co-accused Soshil Mandal has since been extended the privilege of bail in

Patna High Court CR. MISC. No.22774 of 2019(3) dt.05-08-2019 2/2 Cr.Misc. No.15208 of 2019 vide order dated 29.05.2019, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Bhagalpur, in connection with S.T. No.04/2019 arising out of Shahkund (Sajour) P.S. Case No.196 of 2018.
