The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 506 and 509 of the Indian Penal Code. It is alleged that 8 FIR named accused persons including the petitioners and 2-3 unknown came variously armed and assaulted the driver of the informant Santosh Mehta when the informant tried to rescue the driver then co-accused Baua Lal Mukhiya threaten to kill but the informant and Binod Sada tried to rescue the driver then he was assaulted by co-accused Bahuri Mukhiya with iron rod. It is further alleged that when one Binod Sada came to rescue he was also assaulted by the accused persons. In the meantime, when Vinayak Yadav, came to rescue

Patna High Court Cr.Misc. No.53924 of 2015 (2) dt.27-11-2015 2/2 he was assaulted by co-accused Bahuri Mukhiya, the accused persons also assaulted Gulba Devi. It is also alleged that Babunand Mukhiya snatched Rs.1500/-.

It is submitted by learned counsel for the petitioners that accusation is not specific against the petitioners. Moreover, a statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, Birpur, Supaul in connection with Raghopur P.S. Case No.127 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
