Mr. Abhishek Kumar @ Sonu, Advocate For the Opposite Party :

Mr. Sri Manoj Kumar - 1 (APP) ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 30-04-2018 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners apprehend their arrest in connection with Muffasil P.S. Case No. 29 of 2018, registered for the offences punishable under Sections 341, 342, 323, 324, 307, 354(B), 379, 447, 504, 506 of the Indian Penal Code. Allegedly, the petitioners came at the door of the informant, abused her and on objection they assaulted her by lathi. The petitioner no.2 assaulted the informant by lathi on her head and the petitioner no.3 snatched her gold chain and when Babulal Paswan and Anjali Kumari came for rescue they were also assaulted by them.

Patna High Court Cr.Misc. No.21186 of 2018(2) dt.30-04-2018 2/2 Submission is of false implication and that there is case and counter case, the informant has received simple injury on her right hand which is evident from the impugned order itself, now good sense has prevailed between the parties and the informant has filed compromise petition also and, as such, the petitioners deserve sympathetic consideration. The learned A.P.P. fairly submits that from Annexure-3, it reveals that the parties have compromised the case and the informant has filed petition seeking permission to compromise the case also.

In the facts and circumstances as stated above, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, in connection with Muffasil P.S. Case No. 29 of 2018, subject to the conditions as laid down in section 438(2) of the Cr.P.C. Rajiv/- (Jitendra Mohan Sharma, J) U T
