In this case, petitioners are seeking bail in connection with Kateya P.S. Case No. 38 of 2016 registered for offences under sections 147, 148, 149, 341, 323, 337, 338, 307, 297, 504, 506 and 120(B) of the Indian Penal Code.
The people of two villages clashed to each other on account of burial of the dead body. Allegation has been made against the petitioners to have assaulted the victims. The counsel for the petitioners submits that specific allegation has been made against Ali Hussain, Anwar Anzari,
Patna High Court Cr.Misc. No.28608 of 2016 (2) dt.26-07-2016 2/2 Hazrat Mian @ Hazrat Ansari, and Ish Mohammad Mian @ Ish Mohammad to have assaulted the victims and they have already been granted anticipatory bail by this Court in Cr. Misc. Nos. 25761, 16359 and 18041 of 2016.
Looking to facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender before the court below within a period of four weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Kateya P.S. Case No. 38 of 2016, subject to the condition as laid down under Section 438 (2) Cr. P.C.
