Learned counsel for the petitioners is directed to remove the defect(s), as pointed out by the office, within a period of four weeks. The petitioners are apprehending their arrest in Mashrakh P.S. Case No. 49 of 2022 registered under Sections 341, 342, 323, 379, 504, 506/34 of the Indian Penal Code.

Prosecution case in short is that while the informant with his brother was returning home from nursing home, all the accused persons surrounded them and started abusing. It is also alleged that on the threat of dire consequences, demand of extortion of money was made. Cash and chain is also said to have been snatched. It has been submitted on behalf of the petitioners that there is

Patna High Court CR. MISC. No.24945 of 2022(2) dt.20-05-2022 2/2 no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been falsely implicated in the present case. In the garb of petty feud, the present case has been instituted. The allegation of snatching of chain and cash is denied by the petitioners. The offences are triable by Magistrate. Annexure-3 is the case which has been instituted by the petitioners' side against the informant side.

On behalf of the State, it is submitted that the petitioners are not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of learned Judicial Magistrate-Ist Class, Saran at Chapra in connection with Mashrakh P.S. Case No. 49 of 2022 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
