The petitioners are apprehending their arrest in connection with Saharsa Sadar(Sonbarsa Kachhari) P.S. Case No. 132 of 2016 for the offences instituted under Sections 341, 323, 448, 307, 379, 504 and 506/34 of the Indian Penal Code. As per prosecution case, it is a case of mar-pit upon the informant in respect to ridge and boundary wall between the land of both sides which the Panches pacified and it is alleged that on 16.02.2016 after the settlement of issue again the FIR named accused persons having lathi, danda etc in their hands came at the
Patna High Court Cr.Misc. No.27427 of 2016 (2) dt.12-07-2016 house of informant and entered in the room assaulted the informant and others.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. It is a case and a counter case between the parties. The injury on the part of the petitioners' side has not been explained by the prosecution. Both the parties are agnates.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Saharsa Sadar (Sonbarsa Kachhari) P.S. Case No. 132 of 2016 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Saharsa, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
