The petitioner has preferred this application for grant of regular bail in a case registered under sections 364, 120B and 34 of the Indian Penal Code.

As per the prosecution case, it is stated by the informant that her husband entered the house of Brajesh Singh for the purpose of some accounting where it is stated that the other accused persons including the petitioner herein were present. Her husband did not return. The informant further states that on making inquiries she was informed by Brajesh Singh that he has started for his home.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case only

Patna High Court CR. MISC. No.26035 of 2022(4) dt.16-01-2023 2/2 on the basis of unfounded suspicion. The informant is not an eye witness to the petitioner being present at the house of Brajesh Singh. There is delay of three days in lodging of the FIR. One another accused was present at the house of Brajesh Singh, namely, Deepak Singh and he has been enlarged on bail. The petitioner is in custody since 8.10.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the nature of material that has transpired in course of investigation together with the petitioner having remained in custody for 1 year 3 months since 8.10.2021, the petitioner is directed to be enlarged on bail in connection with Sahebpur Kamal P.S. Case no. 252 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai.
