2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code.
3. As per the prosecution case on the alleged date and time of occurrence, these petitioners assaulted informant and others by means of "dab" on account of which three persons sustained injury.
4. It is submitted on behalf of the petitioners that both the petitioners are gotias and due to long standing land dispute between them a simple occurrence of maarpeet took place due
Patna High Court CR. MISC. No.28622 of 2024(2) dt.14-05-2024 2/2 to which both the parties sustained injury. Prior to the present case petitioners side lodged a case in Awatar Nagar P.S. Case No. 365 of 2023 against the informant side which is earlier in point of time. No specific allegation of assault alleged against these petitioners. Petitioners claim clean antecedent.
5. Learned counsel for the State oppose the bail petition.
6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the J.M. 1st class Saran at Chapra in connection with Awatar Nagar P.S.
