The petitioner has preferred this application for grant of regular bail in a case registered under sections 20 and 22 of the NDPS Act.

As per the prosecution case, 4.6 grams of brown sugar is said to have been recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. There is no FSL report on record to the effect that the article allegedly recovered was brown sugar. The petitioner is in custody since 23.1.2021 and has no antecedent under the NDPS

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any antecedent under the NDPS Act and having remained in custody for about 1 year, the Court directs the petitioner to be enlarged on bail in connection with NDPS Case no. 7 of 2021 (arising out of Industrial Area P.S. Case no. 17 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-XI, Bhagalpur. (Partha Sarthy, J) Bibhash U
