The petitioner namely, Dr. Suroj @ Soraj Kr. Sah, apprehends his arrest in a case under Sections 366A/34 of the Indian Penal Code.

The informant named the petitioner along with three other persons and alleged that Surgeon Soren kidnapped his sister with the help of the petitioner and others. It is submitted that the victim made her statement under Section 164 Cr.P.C. wherein she disclosed that Surgeon Soren took her to the market from where she was taken to West Bengal and Surgeon Soren confined her in a room. She alleged that Suregon Soren committed rape with her. It is submitted that the victim also named the petitioner but she did not make any allegation of ill-behaviour against the petitioner. The petitioner brought the victim to Kishanganj from where the police

Patna High Court Cr.Misc. No.52433 of 2015 (2) dt.04-01-2016 2/2 recovered her. The petitioner did not kidnap the victim. Considering the facts aforesaid and the fact that the victim did not make any allegation of ill-treatment against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in Bahadurganj P.S. Case No. 225/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
