JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and the State. Petitioner is apprehending arrest in connection with Imamganj P.S. Case No. 97 of 2017 for an offence under section 7 of the Essential Commodities Act.

In this case, case diary was called for vide order dated 15.09.2017.

Counsel for the petitioner submits that petitioner is the Chairman of Paacs and in that capacity he was granted license of PDS dealership. He submits that in the instant case there is no complaint by any consumer that this petitioner has played any mischief for supply of rice and wheat to the card holders. He further submits that petitioner is ready to extend full cooperation in the enquiry and since he has no criminal antecedent and he

Patna High Court Cr.Misc. No.39841 of 2017 (3) dt.17-10-2017 2/2 being Chairman of Paacs is a public personality and as such there is no apprehension that he will abscond from the course of justice. He also submits that he is ready to abide by any terms and conditions imposed by this court.

Considering the totality of the facts situation and the fact that the petitioner is a dealer under the Public Distribution System and there is no specific complaint by the consumer against the petitioner coupled with the fact that there is no criminal antecedent, let the petitioner, named above, be released on bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Sherghati, in connection with Imamganj P.S. Case No. 97 of 2017 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that the petitioner will cooperate in the investigation and will not, in any manner, influence the evidence or the witnesses.
