ANJANA MISHRA ORAL ORDER 29-03-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 420/347 /379/376/511/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that though the notices were issued to the opposite party No. 2 on the earlier occasion yet she has chosen not to appear. However, in the meanwhile, the Police after due investigation has submitted final form but the petitioner has not been sent up for trial vide chargesheet No. 576 of 2014 dated 03.12.2014, whereas another accused Dhirendra Ram has been sent up for trial. A copy of the chargesheet No. 576/2014 dated 03.12.2014 has been produced and is kept on record.
In view of the aforementioned submissions, let the
Patna High Court Cr.Misc. No.43919 of 2014 (6) dt.29-03-2016 P2/2 petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Shastri Nagar P.S. Case No. 386/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
