JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-08-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Angarh P.S. Case no. 17 of 2016, registered under Sections 420, 406/34 of the Indian Penal Code.

The accusation is that one Musbbir reached at the Jewellery shop of the informant and proposed to sale bangles in weight 17 grams and 520 mg on consideration amount of Rs. 35, 000/- when informant tested the bangles, the same was found duplicate. Thereafter, he was caught hold by the informant and others. On query, he disclosed the name of the petitioners and other as a member of his gang.

No.33299 of 2016 (2) dt.24-08-2016 2/2 Learned counsel for the petitioners submits that, in fact, it would appear from the F.I.R. that the name of the petitioner was disclosed by one Musbbir, who is said to be apprehended by the informant and others at the time of selling of duplicate gold bangles. Further submission is that petitioners having no criminal antecedent and they have falsely been implicated in this case.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with Angarh P.S. Case No. 17 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
